1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the DAL Real Estate Intelligence platform at dalintel.com (the “Platform”), operated by DAL (“we,” “us”). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Description of the Service

DAL provides real estate market data, benchmarking tools, and modeled analytical estimates covering residential and commercial properties in Saudi Arabia, including price benchmarking, market opportunity signals, and investment simulation tools.

Important: DAL is an information and analytics tool. It is not a licensed real estate appraiser, financial advisor, or investment advisor. Nothing on the Platform — including price estimates, market signals, or simulation outputs — constitutes professional real estate, investment, financial, tax, or legal advice, or a guarantee of any property’s value, future performance, or investment outcome. You are solely responsible for any decisions you make based on information provided by the Platform, and should seek independent professional advice before making investment or real estate transaction decisions.

3. Eligibility and Business Use Only

The Platform is designed and offered exclusively for use by businesses, real estate investors, and professionals acting in their professional or commercial capacity (“Business Users”). The Platform is not intended for use by consumers for personal, family, or household purposes. By creating an account, you represent that you are accessing and using the Platform for business or professional purposes.

You must be at least 18 years old and capable of entering into a legally binding contract under the laws of Saudi Arabia to use the Platform.

4. Account Registration

You must provide accurate and current information when creating your account and keep it up to date. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access to your account.

5. Subscription Plans and Billing

5.1 Plans

Free — access to city-level market pulse data and limited platform features at no cost.
Pro — 599 SAR per month, billed monthly, providing full access to district-level intelligence, market signals, price benchmarking, and the full analytical toolkit.

5.2 Auto-Renewal

Pro subscriptions automatically renew each month at the then-current price unless cancelled before the renewal date. The auto-renewal terms of your plan are disclosed to you at the point of subscription, before payment is taken. By subscribing, you authorize DAL and its payment processor to charge your saved payment method on each renewal date.

5.3 Cancellation

You may cancel auto-renewal at any time from your account settings, through a simple and easily accessible cancellation process. Upon cancellation, you retain Pro access until the end of your current paid billing period, after which your account reverts to the Free plan. Cancellation does not entitle you to a refund for the current billing period.

5.4 Refunds

We do not provide refunds for partial billing periods. If you believe you were charged in error, contact [email protected] and we will review your case.

5.5 Failed Payments

If a renewal payment fails, we will notify you by email. Our system will continue attempting to process payment on your saved payment method on a daily basis until either the payment succeeds or your current billing period ends. If payment has not succeeded by the end of your current billing period, your account will automatically be downgraded to the Free plan.

6. Payment Processing

Payments are processed by Moyasar, a SAMA-regulated Saudi payment service provider, and accepted via Mada, Visa, and Mastercard in Saudi Riyals (SAR). Your card details are submitted directly to Moyasar and are never stored on DAL’s servers in full.

7. Acceptable Use

You agree not to:

Scrape, crawl, or systematically extract data from the Platform outside of normal use
Reverse engineer, decompile, or attempt to access the underlying analytical models or source code
Resell, redistribute, or sublicense Platform data or access without our prior written consent
Use the Platform’s data, outputs, or models — in whole or in part — to train, develop, test, or improve any artificial intelligence, machine learning, or competing real estate analytics or valuation model or service
Use the Platform for any unlawful purpose or in violation of Saudi law
Attempt to interfere with, disrupt, or gain unauthorized access to the Platform or its infrastructure
Share your account credentials with any other person

We reserve the right to suspend or terminate accounts that violate this section.

8. Intellectual Property

The Platform, including its underlying software, valuation models, design, and DAL branding, is the exclusive property of DAL and is protected by applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to access and use the Platform solely for your own internal business purposes as a Business User. You retain no ownership rights in the Platform itself. You retain ownership of any information you provide to us, subject to our Privacy Policy.

9. Disclaimers

The Platform and all data, estimates, and analytical outputs are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to accuracy, completeness, merchantability, or fitness for a particular purpose. Modeled price estimates and market signals reflect statistical analysis of available data and are not guarantees of actual market value or investment performance. Real estate markets are inherently uncertain, and actual outcomes may differ materially from any estimate or projection shown on the Platform.

10. Limitation of Liability

Nothing in these Terms limits or excludes DAL’s liability for fraud, willful misconduct, or gross negligence, or for any other liability that cannot be limited or excluded under mandatory provisions of Saudi law, including the Civil Transactions Law.

Subject to the foregoing, and to the maximum extent otherwise permitted under Saudi law, DAL and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of or inability to use the Platform, or from any investment or business decision made in reliance on Platform data. Subject to the first paragraph of this Section, DAL’s total liability for any claim arising from these Terms or your use of the Platform shall not exceed the total amount you paid to DAL in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless DAL, its officers, employees, and affiliates from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your breach of these Terms; (b) your violation of any applicable law or regulation; or (c) your unauthorized use, misuse, or unlawful disclosure of Platform data. This obligation survives termination of your account.

12. Termination

We may suspend or terminate your account immediately and without prior notice where we reasonably believe you have engaged in fraudulent or unlawful conduct, committed a material breach of these Terms, or where immediate action is required by law. For any other breach of these Terms, we will provide you with at least 14 days’ written notice and a reasonable opportunity to cure the breach before suspension or termination.

You may terminate your account at any time by contacting [email protected]. Sections of these Terms that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification — will remain in effect.

13. Force Majeure

DAL shall not be liable for any failure or delay in performance under these Terms resulting from causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, governmental or regulatory action (including action by SDAIA or other competent authorities), internet or telecommunications infrastructure failures, or failures of third-party service providers.

14. Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Riyadh, Saudi Arabia.

15. Notices

Any formal legal notice required to be given under these Terms must be delivered in writing: to you, at the email address associated with your account; or to DAL, at [email protected]. Notices are deemed received on the date of transmission, subject to reasonable proof of delivery.

16. Severability

If any provision of these Terms is held by a competent Saudi court or arbitral tribunal to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

17. Entire Agreement; Waiver

These Terms, together with the Privacy Policy, constitute the entire agreement between you and DAL regarding your use of the Platform, and supersede any prior agreements or understandings, whether written or oral, relating to that subject matter. No failure or delay by DAL in exercising any right under these Terms shall operate as a waiver of that right.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Platform before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

2. وصف الخدمة

تقدّم DAL بيانات السوق العقاري وأدوات المقارنة المرجعية والتقديرات التحليلية النموذجية التي تغطي العقارات السكنية والتجارية في المملكة العربية السعودية، بما في ذلك المقارنة المرجعية للأسعار، وإشارات الفرص السوقية، وأدوات محاكاة الاستثمار.

يجب أن يكون عمرك 18 عامًا على الأقل وأن تكون قادرًا على إبرام عقد ملزم قانونًا بموجب أنظمة المملكة العربية السعودية لاستخدام المنصة.

4. تسجيل الحساب

5. باقات الاشتراك والفوترة

5.1 الباقات

مجانية — الوصول إلى بيانات نبض السوق على مستوى المدينة وميزات محدودة من المنصة دون تكلفة.
Pro — 599 ريال شهريًا، تُفوتر شهريًا، وتوفّر وصولاً كاملاً إلى ذكاء مستوى الأحياء، وإشارات السوق، والمقارنة المرجعية للأسعار، وكامل الأدوات التحليلية.

5.2 التجديد التلقائي

تتجدد اشتراكات Pro تلقائيًا كل شهر بالسعر الحالي حينها ما لم يُلغَ الاشتراك قبل تاريخ التجديد. تُفصح لك شروط التجديد التلقائي لباقتك عند نقطة الاشتراك، قبل تحصيل الدفعة. باشتراكك، فإنك تخوّل DAL ومعالج الدفع الخاص بها بتحصيل المبلغ من وسيلة الدفع المحفوظة لديك في كل تاريخ تجديد.

5.3 الإلغاء

يمكنك إلغاء التجديد التلقائي في أي وقت من إعدادات حسابك، عبر إجراء إلغاء بسيط وسهل الوصول إليه. عند الإلغاء، تحتفظ بوصول Pro حتى نهاية دورة الفوترة الحالية المدفوعة، وبعدها يعود حسابك إلى الباقة المجانية. لا يمنحك الإلغاء الحق في استرداد المبلغ عن دورة الفوترة الحالية.

5.4 الاسترداد

لا نقدّم استردادًا عن فترات الفوترة الجزئية. إذا كنت تعتقد أنه تم تحصيل مبلغ منك عن طريق الخطأ، تواصل مع [email protected] وسنراجع حالتك.

5.5 فشل الدفع

إذا فشلت عملية دفع التجديد، سنُبلغك عبر البريد الإلكتروني. سيستمر نظامنا في محاولة معالجة الدفع من وسيلة الدفع المحفوظة لديك يوميًا حتى نجاح الدفع أو انتهاء دورة الفوترة الحالية. إذا لم تنجح عملية الدفع بحلول نهاية دورة الفوترة الحالية، سيُخفَّض حسابك تلقائيًا إلى الباقة المجانية.

6. معالجة الدفع

تُعالج المدفوعات عبر Moyasar، مزوّد خدمات الدفع السعودي الخاضع لتنظيم ساما، وتُقبل عبر مدى، وفيزا، وماستركارد بالريال السعودي (SAR). تُقدَّم بيانات بطاقتك مباشرة إلى Moyasar ولا تُخزَّن أبدًا بشكل كامل على خوادم DAL.

7. الاستخدام المقبول

توافق على عدم القيام بما يلي:

سحب أو زحف أو استخراج بيانات من المنصة بشكل منهجي خارج نطاق الاستخدام الاعتيادي
الهندسة العكسية أو فك التجميع أو محاولة الوصول إلى النماذج التحليلية الأساسية أو الشيفرة المصدرية
إعادة بيع أو إعادة توزيع أو منح ترخيص من الباطن لبيانات المنصة أو الوصول إليها دون موافقتنا الكتابية المسبقة
استخدام بيانات المنصة أو مخرجاتها أو نماذجها — كليًا أو جزئيًا — لتدريب أو تطوير أو اختبار أو تحسين أي نموذج ذكاء اصطناعي أو تعلّم آلي أو خدمة تحليلات أو تثمين عقاري منافِسة
استخدام المنصة لأي غرض غير مشروع أو بما يخالف النظام السعودي

8. الملكية الفكرية

المنصة، بما في ذلك برمجياتها الأساسية ونماذج التثمين والتصميم وعلامة DAL التجارية، هي ملك حصري لـ DAL ومحمية بموجب أنظمة الملكية الفكرية المعمول بها. تمنحك هذه الشروط ترخيصًا محدودًا وغير حصري وغير قابل للتحويل للوصول إلى المنصة واستخدامها فقط لأغراضك التجارية الداخلية كمستخدم أعمال. لا تحتفظ بأي حقوق ملكية في المنصة نفسها. تحتفظ بملكية أي معلومات تقدّمها لنا، وفقًا لسياسة الخصوصية الخاصة بنا.

لا يحدّ أي بند في هذه الشروط أو يستثني مسؤولية DAL عن الاحتيال أو سوء السلوك المتعمّد أو الإهمال الجسيم، أو أي مسؤولية أخرى لا يجوز الحد منها أو استثناؤها بموجب أحكام إلزامية في النظام السعودي، بما في ذلك نظام المعاملات المدنية.

مع مراعاة ما سبق، وإلى أقصى حد يسمح به النظام السعودي، لن تكون DAL ومسؤولوها وموظفوها وتابعوها مسؤولين عن أي أضرار غير مباشرة أو عرضية أو خاصة أو تبعية أو تأديبية، أو أي خسارة في الأرباح أو الإيرادات أو البيانات، ناشئة عن استخدامك للمنصة أو عدم قدرتك على استخدامها، أو عن أي قرار استثماري أو تجاري تتخذه اعتمادًا على بيانات المنصة. مع مراعاة الفقرة الأولى من هذا القسم، لن تتجاوز مسؤولية DAL الإجمالية عن أي مطالبة ناشئة عن هذه الشروط أو عن استخدامك للمنصة إجمالي المبلغ الذي دفعته لـ DAL خلال الاثني عشر (12) شهرًا السابقة للمطالبة.

11. التعويض

12. الإنهاء

يجوز لنا تعليق أو إنهاء حسابك فورًا ودون إشعار مسبق إذا كان لدينا اعتقاد معقول بأنك انخرطت في سلوك احتيالي أو غير مشروع، أو ارتكبت إخلالاً جوهريًا بهذه الشروط، أو عندما يتطلب النظام إجراءً فوريًا. بالنسبة لأي إخلال آخر بهذه الشروط، سنقدّم لك إشعارًا كتابيًا لا يقل عن 14 يومًا وفرصة معقولة لتصحيح الإخلال قبل التعليق أو الإنهاء.

14. النظام الحاكم

تخضع هذه الشروط لأنظمة المملكة العربية السعودية. يخضع أي نزاع ينشأ عن هذه الشروط أو يتعلق بها للاختصاص القضائي الحصري للمحاكم المختصة في مدينة الرياض بالمملكة العربية السعودية.

15. الإشعارات

يجب تسليم أي إشعار قانوني رسمي مطلوب بموجب هذه الشروط كتابيًا: إليك، على عنوان البريد الإلكتروني المرتبط بحسابك؛ أو إلى DAL، عبر [email protected]. تُعتبر الإشعارات مستلمة في تاريخ إرسالها، مع مراعاة إثبات معقول للتسليم.

16. قابلية الفصل

إذا اعتبرت محكمة سعودية مختصة أو هيئة تحكيم أي بند من هذه الشروط باطلاً أو غير قابل للتنفيذ، يُقيَّد ذلك البند أو يُستبعد بالحد الأدنى اللازم فقط، وتستمر بقية البنود سارية المفعول بالكامل.

17. الاتفاقية الكاملة؛ التنازل

تشكّل هذه الشروط، إلى جانب سياسة الخصوصية، الاتفاقية الكاملة بينك وبين DAL بشأن استخدامك للمنصة، وتحل محل أي اتفاقيات أو تفاهمات سابقة، سواء كانت مكتوبة أو شفهية، تتعلق بهذا الموضوع. لا يُعدّ أي تقصير أو تأخير من DAL في ممارسة أي حق بموجب هذه الشروط تنازلاً عن ذلك الحق.

18. التغييرات على هذه الشروط

قد نحدّث هذه الشروط من وقت لآخر. سيتم إبلاغك بأي تغييرات جوهرية عبر البريد الإلكتروني أو إشعار بارز على المنصة قبل سريانها. يشكّل استمرار استخدامك للمنصة بعد سريان التغييرات قبولاً للشروط المعدَّلة.
